Udi Stakeholders Storm Court, Demand Order Restraining Aneke From Parading As PDP LG Chair




In pursuant to Section 2; Section 47(5) of the Constitution of the Peoples Democratic Party (PDP) 2012 (as amended) and  PDP  Electoral Guidelines for the 2023 General Election, an originating summons seeking among others, an order restraining Mr. Okechukwu Aneke who is the 1st Defendant from parading himself as the Chairman of the 2nd Defendant in Udi Local Government Area of Enugu State is being sought.


The order which was filed by Samuel C. Chukwu and 
Raymond Nkannebe; Esq for DECENCY SOLICITORS on behalf of their clients, Emmanuel Ogbozor and Daniel Eneaniofu who are the Plaintiffs on Friday May 20 at  the Federal High Court in the Abuja Judicial Division
holden at Abuja, is seeking three prayers which are;

"AN ORDER restraining the 1st Defendant from parading himself as the Chairman of the 2nd Defendant in Udi Local Government Area of Enugu State.

"AN ORDER directing the leadership of the 2nd and 3rd Defendants to desist from recognizing the 1st Defendant as the Chairman of the 2nd Defendant in Udi Local Government Area of Enugu State.

"AN ORDER directing officers and men of the 4th and 5th Defendants to give effect to relief No 2 above, in order to forestall a possible breakdown of law and order in Udi Local Government of Enugu in particular, and Enugu State at large".


 According to the document sighted by our correspondent on Friday night, the summons are to be served the three defendants; 1st Defendant Mr. Okechukwu Aneke
De’Angelo Hotel, Golf Estate,
Enugu, 2nd Defendant
People’s Democratic Party PDP National Headquarters WADATA Plaza Wuse Zone 5 Abuja and 3rd Defendant Independent National Electoral Commission
Plot 436 Zambezi Crescent,
Abuja.


Also joined in the suit are 4th and 5th Respondents,  Nigeria Police Force Headquarters Louis Edet House Abuja.

"LET the Defendants within Thirty (30) days of service of this Summons on them, inclusive of the day of such service, cause an appearance to be entered for them to this summons issued upon the application of the Plaintiffs herein named whose address for service is: Decency Solicitors, No: 2 Tanga Street, Wuse Zone 6, Abuja who seek the determination of the following questions and claim the reliefs set our hereunder:
QUESTIONS FOR DETERMINATION
Whether having regard to Section 47(5) of the PDP Constitution 2012 (as amended), and the PDP Electoral Guidelines for the 2023 General Election, the 1st Defendant can continue to preside over the affairs of the 2nd Defendant in Udi Local Government Area of Enugu State, being an Aspirant for the Udi South Constituency Legislative Seat in the Enugu State House of Assembly under the platform of the 2nd Defendant?" The document stated.

 The Plaintiffs claim in consequence the following reliefs:
"A DECLARATION that by the provision of Section 47(5) of the PDP Constitution 2012 (as amended) and the PDP Electoral Guidelines for the 2023 General Election, the 1st Defendant is not eligible to continue to preside as the 2nd Defendant’s Chairman in Udi Local Government Area of Enugu State being an Aspirant for the Udi South Constituency Legislative Seat in the Enugu State House of Assembly under the platform of the 2nd Defendant? "
